    RENO, Nev. -- A former Harrah's employee has filed a motion to dismiss a lawsuit that accuses Pittsburgh Steelers quarterback Ben Roethlisberger of raping another worker.

    Stacy Dingman is the former director of hotels at Harrah's and one of nine defendants named in the lawsuit filed last month in Washoe County District Court. The suit also accuses managers of the hotel-casino at Lake Tahoe of covering up the alleged sex assault.

    She also said she is the former best friend of the woman who claims Roethlisberger raped her at the hotel-casino during an annual celebrity golf tournament in July 2008.

    Dingman said in her motion that the lawsuit is baseless and that she has been dragged into it without justification.

      In a statement released by lawyer David Cornwell, Steelers quarterback Ben Roethlisberger takes a howitzer to the lawsuit filed against him alleging sexual assault.

      Cornwell attaches to his statement e-mail messages sent by McNulty to the fictitious soldier, who had been fabricated by the wife of a man with whom the plaintiff supposedly had been involved.

      Says Cornwell: "We believe that [the plaintiff's] own words directly refute the scurrilous allegations made in her Complaint. The attached documents, containing what we believe are [the plaintiff's] own words, are merely the tip of the investigative iceberg.

      "[The plaintiff] should abandon her lawsuit immediately and admit that Ben Roethlisberger did not rape her."

      Per Cornwell, the plaintiff wrote two days after the alleged sexual assault that she was looking forward to having dinner with Roethlisberger and other celebrities attending the American Century Celebrity Golf Championship.

      Then, five months after the alleged assault, she wrote that she "would date Ben Roethlisberger" if the made-up soldier were to end their relationship.

      We'll be looking over the e-mails and possibly adding more details and analysis. For now, it's clear that Cornwell and Roethlisberger are adopting a very aggressive posture. It remains to be seen whether it works.

                This is far from over, but the plantiff is on very shaky ground. Unfortunately since lawyers are generally slimeballs her lawyer will drag this out with hope of a pay off to recoup his expenses since the plantiff clearly has little financial resources to pay her lawyer what he expected to get out of this going in.

                  I have to run out to a meeting, but I'll provide a more detailed explanation later.

                  Basically, you are correct -- this is not over. The evidence looks very favorable for Ben, but to dismiss the case at this stage, you look not at the evidence, but just the allegations themselves.

                  The motion to dismiss was filed on behalf of one of the Harrah's employees, not Ben.

                      I believe so, but a motion to dismiss has only been filed so far. It hasn't actually been dismissed at this point.

                        I know we have doctors on this board but any lawyers who can fill us in on how this works?

                        I also read it as one of the defendants was asking to have her specific name removed from the suit not the dismissal of the suit itself.
