      Attorney for Pounceys vows action If alleged assault victim “continues to perpetuate these lies”

      Evidence in the aftermath of a party at a nightclub reportedly showed no signs that Mike or Maurkice Pouncey assaulted Riquan James, but that isn’t stopping James from planning a lawsuit against the brothers for injuries he allegedly received as a result of an assault at the club.

      James also alleges that the brothers fired homophobic taunts in his direction, but the attorney for the brothers offered a strong denial of all the charges to the Miami Herald on Tuesday night.

      “Mike and Maurkice were not involved in any altercation with the accuser or anyone else that night and did nothing wrong,” Jeff Ostrow wrote in the statement to the paper. “It appears that the accuser is an opportunist seeking attention and possible financial gain. Any attempt by the accuser or anyone else to bring an action against them based upon these false allegations will be vigorously defended. If the accuser continues to perpetuate these lies, we will bring an action against him.”

      While James and two others involved in the lawsuit have spoken to the media about the incident and their plans for litigation, but they have yet to speak to the Miami Beach Police Department. Police spokesman Sgt. Bobby Hernandez says the department has been “anxiously awaiting” a conversation since the allegations were made on Saturday night.

            Word emerged late Friday afternoon that Steelers quarterback Ben Roethlisberger had settled the sexual assault lawsuit filed against him in July 2009 in Nevada. It’s the ideal time each week for otherwise significant developments to go largely unnoticed.

            Given the events of the intervening weekend, including two epic conference title games and the passing of legendary Penn State coach Joe Paterno, the Roethlisberger settlement quickly has been forgotten.

            But we’ve got some news. Though no one is saying anything publicly about whether and to what extent money changed hands, a league source tells PFT that the alleged victim received “less than a game check.”

            Based on Roethlisberger’s 2011 salary of $6 million, a game check costs $352,941.17. Based on his 2012 salary of $11.6 million, a game check amounts to $685,352.94.

            In contrast, Roethlisberger lost $1.894 million via his four-game suspension in 2010 following the allegations of sexual assault in Georgia, which resulted in no prosecution.

            Relative to Roethlisberger’s earnings, a settlement in the mid-six-figure range won’t hurt very much, and it could ultimately be even less than what it would have cost to fully litigate the case through trial, especially if Roethlisberger wanted a scorched-earth Cadillac defense.

            While Roethlisberger surely admitted to no wrongdoing as part of the settlement, plenty of people will presume that he wouldn’t have paid money if he was innocent. The reality, however, is that the passage of time likely allowed him to view it dispassionately as a business proposition, and to make a smart decision independent of whether he believes he would have been vindicated after spending as much or more on legal fees, with the ever-present possibility that he’d lose at trial and pay a lot more.

                I don't care what degree he has; he doesn't even grasp what a debate is. That is akin to a 3-year-old wanting to wrestle. It was never a debate to begin with and he doesn't understand that most basic concept.

                  So you think $685k is not a significant amount of money? Salute, Godfather. Fact is, the case didn't "fizzle away" as the board's Leboo claimed. He, in FACT, settled out of court. Big difference.

                    For an out of court settlement, a game check was very little.

                    Not like he had to pay he $50 million

                      Miami Dolphins center Mike Pouncey and brother face lawsuit over alleged altercation at Cameo nightclub

                      Riquan James is telling anyone who will listen that Mike and Maurkice Pouncey pummeled him early Saturday morning.

                      Anyone, it seems, except the Miami Beach Police Department.

                      James’ attorney called a news conference Tuesday to announce a lawsuit against the NFL stars, claiming they beat his client up at South Beach’s Cameo nightclub early Saturday.

                      Miami Beach Police responded to an altercation at the club. But they say they are waiting for

                      James to come in and give detectives his version of events of the Pouncey brothers’ South Beach birthday party.

                      “We need them to come forward and speak to investigators,” said Sgt. Bobby Hernandez, a Miami Beach police spokesman. “We’ve been anxiously awaiting that since they made the allegations on Saturday.”

                      The twins’ attorney says the allegations are patently false. In a statement to the Miami Herald late Tuesday, Jeff Ostrow, personal counsel to the Pounceys, called the accusations “lies.”

                      “Mike and Maurkice were not involved in any altercation with the accuser or anyone else that night and did nothing wrong,” Ostrow wrote. “It appears that the accuser is an opportunist seeking attention and possible financial gain. Any attempt by the accuser or anyone else to bring an action against them based upon these false allegations will be vigorously defended. If the accuser continues to perpetuate these lies, we will bring an action against him.”

                      Nonetheless, James and two others plan to go forward with a lawsuit against Mike and Maurkice Pouncey, star offensive linemen for the Dolphins and Steelers, respectively.

                      James, 24, Niya Pickett, 32, and Brentley Williams, 24, have hired personal injury attorney Marwan Porter, who confirmed that a lawsuit will be filed by week’s end.

                      “This kind of conduct cannot be tolerated,” Porter said. “These are big men. They cannot conduct themselves in this manner. They think they can get a free pass.”

                      James told the Miami Herald on Tuesday that he had just arrived at Cameo about 4 a.m. when some shoving began.

                      James, who said he was invited to the annual party by former Dolphins lineman Bryant McKinnie, claims the identical Pouncey brothers were pushing a group of people as he walked in.

                      Soon, he got shoved too. He asked them to stop. One of the brothers – who at least one witness believes was Maurkice – didn’t like that, James said. Then the Pouncey brother, the much smaller James continued, responded first with homophobic taunts – and then fists.

                      “I heard a series of slurs from the Pouncey brothers, referring to me as less than a man, a f-----, a b----,” said James. “I assume me asking them not to touch me rubbed them the wrong way.

                      “Then someone turned me around, and one of the Pouncey brothers hit me in the face," he added. “A gang of guys hit me. To protect myself from being really injured, I crawled up into a fetal position, until I got thrown out [of the club].”

                      Despite his efforts, James still got hurt. He has two knots on his forehead. His face is still swollen. A tooth chipped. And his head still throbs. He put pictures of the injuries on Instagram.

                      Step one of the litigation process is making sure whatever surveillance video of the incident remains intact, Porter said. He has sent Cameo a written request to not alter or delete the footage, which also likely will be part of any Miami Beach police investigation.

                      Williams, who didn’t know James before the night of the party, didn’t hear the alleged slurs, but claims she did see a Pouncey brother strike James. In the melee that ensued, she ended up on the floor, and was cut by broken glass. She needed nine stitches on her leg, she said. Williams acknowledged that she had yet to give her account to law enforcement.

                        It wasn't $685, it was less than that. And it was likely less than $352, based on the salary year. A settlement in the low six figures is cost of defense with the rates that he was paying Cornwell, particularly considering the scorched earth approach that Cornwell was taking.

                        When you can buy certainty for the cost of defense, you do it. Particularly where you also get a negative story out of the headlines.

                          I haven't read all the details, but this seems like total BS. The fact that the accuser won't speak with police raises serious credibility issues.

                              Yes, the Nevada case against Ben fizzled. That's what lawyers call it when a plaintiff sues for big bucks and settles for peanuts, a/k/a, nuisance value. Fact is, nobody knows what the dingbat got, so all the yakking about a "game check" or "half a game check" is bull****.

                              What we do know is that after she filed the suit, a lot of evidence (including her own e-mails) became public and exposed her as a liar. Ben's lawyers were then threatening to sue HER. It wasn't long before her lawyer publicly reduced her demands to these: That Ben would admit the rape, apologize, and donate $100,000 to some organization for abused women. That PUBLIC offer was rejected immediately.

                              Now tell me why he would then settle the case for a game check or half a game check. That's pure bull**** and you bought it. You're not just a nasty prick; you're stupid. LeBoo THAT.
