Maybe Ben and Co. should fight back in the court of public opinion.

Here's a reasonable scenario about what happened, maybe my best guess: DTF chick was flirting with Ben all night. It's been reported that she actually pinched him earlier in the evening. They decide, together and consensually, to go to the bathroom for sex. Once there, either Ben saw she was TOO drunk and ended it before it was "consumated" (explaining no Ben DNA on her - no hair follicles, skin cells, etc.), or possibly oral stuff occurred (this being a family forum, I'll leave it at that). Either way, NOTHING happened that wasn't consensual. I'll tell you I'm not some wild dude, but even I saw this stuff happen a long time ago when I was in college.

Now the bodyguard statements are coming out that things didn't happen like the DTF chick and her DTF girlfriends say. And statements that she pinched him - that sounds like she was not averse to physical contact, to say the least.

Ben will never recover, much less go to the HOF as long as this case remains ... unconsumated. Maybe he should sue DTF chick and her posse for defamation of character, slander, etc.? Show the world that the worst thing he did was act like he was still in college, but NEVER did anything more wrong than that. I think a lot of people will forgive/understand that, and he can get on with his career.

What say you guys?

I've been saying all along her side of the story is BS. I also believe whatever took place was consensual. And I agree that his side needs to speak up as loudly as the drunk, underage sorority sisters.

Trooper Joyner said he never stopped anyone from going in the hallway area of the bar and never saw anyone else in the group do so.

How could he be at the main bar getting Red Bulls, if his friend said he was on the back "messing" around with this chick?

Plus the girl did have "some" seamen on her. Not enough to get enough of a match to be prove anything in court beyond reasonable doubt, but I think it's safe to assume that if she had seamen on her that she wasn't just making out with Ben.

The main question is was it consensual or not. That is the part which only two people know...

Ben wasn't getting the Red Bulls, Barravecchio was. Also, who said semen was found? They said some dna, but not enough to use. Since the dna was so minute, it could have come from anywhere, maybe even the girls lay the previous night, who knows.

Yeah, I totally mis-read that. I guess the dna could have come from another night, but I would assume the girl would at least shower after. If not Ben is "messing" around with some really shanky girls... :lol:

I doubt we will ever have all the answers here. I believe the truth in these kinds of cases tends to lie somewhere in the middle.

With that said, it would not be in Ben's best interest to go on the offensive. He screwed up. He lost his head and eff'd royally. The consequences of drinkin' and sexin' in a public restroom for an NFL superstar can be monumental. Ben has learned that through pain and embarassment. One thing I have learned in life. I can't control others. But, I can control myself...my actions. I ask myself what was my role in this negative situation. Ben needs to ask himself the same thing, learn from it, forgive himself, get better and move on.

There is a reason Ben won't go on the offensive.... it's the money. I think he paid her and also agreed to stop talking.

Why else would Ben not fight this tooth and nail after the fact?

Yes. Our little angel, in whose mouth sugar wouldn't melt according to the media and the oh so impartial DA, was wearing a big button that said exactly that. When Ben asked her what it meant, she said "It means Down to F***". Actually, several of the girls in her posse were wearing it.

OK, we cannot believe the girls because of course they will lie for a friend. But bodyguards paid by the accused, who would be in line for charges themselves if a crime happenned; these are much more credible. Yeah, Right. :roll:

Makes sense to me. If regular Joes can come up with such an obvious answer to Ben's troubles why cant his legal team?

You gave a scenario, I will give you one which explains why he aint talkin. At the best "the truth" will is ugly but not a crime. At worst it is a crime. If the truth would put him in a better light, where people are going to be more understanding, it makes absolutely no sense to keep quiet.

The burden of proof is on the prosecution, not the defense. It is not up to the accused to prove innocence. It is up to the accuser to prove guilt. They couldn't do it.

I think Ben's side won't ever speak. My guess is that this is becasue there was some form of "sexual contact" that occured.

Unfortunately for ben:

1) She was underage and apparently really drunk.
2) Ben was buying booze for the VIP party.

My guess is that Ben admitting to sexual contact is admitting to sexual assault because she was too drunk to give consent. I think if nothing happened, he'd be screaming it from the rooftops (and the lawyers woudln't be advising him to say nothing).

To those who belive that Ben did no wrong, doesn't it trouble you that he won't give his side of the story? Don't you think that means that something happened?

Also, for those that are using the fact that she was very drunk as a strike against her and are saying that the sex was consensual, what are the laws for consent in the US? I know in Canada you can't consent if you're hammered.

We're not talking legally here, Jack. There's a reason fathers don't want their daughters going out dressed up like porn stars. In the court of public opinion, they don't come across well.

According to the DA, Ben is presumed as legally innocent as you or I of breaking the law in Milledgeville that night - charges would have been filed otherwise. But we're not talking about that now.

Do I wish Ben acted like he wasn't a college frat boy? As the face of the franchise, of course I do. But a girl who is bar hopping, "coincidentally" arriving at two or three bars right after Ben does; has a button on that says "DTF" and then explains graphically what it means to anyone who asks; who initiated physical contact with Ben (pinching him); engaged in graphic sexual conversation with him (according to the DA); and who willingly drank enough to be completely wasted (BAC 0.2%) - well she doesn't exactly come across as an angel. That's all I'm saying.

No argument. Thats what taking the 5th is all about. He has the right not to make "INCRIMINATING" statements. Any statement Ben makes can be used in a court of law.

Look at what this thread is about. Defenders are saying Ben should just talk. All would be forgiven. IF THE TRUTH IS WHAT YOU THINK IT IS WHY NOT RESTORE YOUR IMAGE.

Apparently Ben's case is best served by his keeping his trap shut.

When Ben had on a drink like a champion tshirt was he obligated to drink like a champion or face repercussions? A DTF sticker means a chick had to want to fkuc before she got home? It's like the girls who dress like hoes... they definitely want attention but if you walk up and say "hey hoe" most will act offended.

Nowadays you can be in the act of sex and if she says stop and you don't immediately stop it's considered rape. A sticker is a weak argument or reason to convnce a person she wanted it.

Not saying I know what went down either...
